TERMS AND CONDITIONS - INTERACTING WITH A SMART BOTTLE OR OTHER SUPPORT FACILITATED BY UNIVERRE

INTRODUCTION

Effective as of October 2023

These Terms and Conditions set out the rules and guidelines for participating in the user experience enabled by NFC or QR Code associated with a wine bottle or other medium, facilitated by Univerre Pro Uva (the provider of hardware: NFC or QR Code technology, and software: digital experience), in collaboration with the wine producer or other client.

 

The primary objective of this experience is to create an enjoyable and engaging user experience for participants. By scanning a bottle or other medium equipped with NFC or a QR Code, or by participating in this experience through our platform, users agree to comply with these Terms and Conditions.

1. ELIGIBILITY

The NFC or QR Code–enabled user experience is open to individuals who have reached the legal drinking age in Switzerland or in the country where they are using the bottle or other medium.

2. DESCRIPTION OF SERVICE

Our platform offers a range of services, including hardware solutions such as NFC tags, QR Code generation, and digital printing services, as well as software services such as simple digital experiences, interactive digital experiences, and the development of tasting experiences for products.

The platform also provides a user dashboard for NFC and QR Code interaction data, available to wine producers or other clients who equip their bottles with NFC tags or QR Codes. This dashboard includes detailed reports on NFC and QR Code interactions, as well as the ability to export data.

3. USER ACCOUNTS

User account registration is reserved exclusively for B2B clients, allowing them to access interaction data related to their products. B2B clients will have access to detailed reports, NFC or QR Code interaction data, and the ability to export data through their user accounts.

Consumers (end users) can only access the homepage and view related information. They may participate in interactive games, tastings, and other activities facilitated by the NFC or QR Code–enabled user experience, but they will not be able to create user accounts.

4. USE OF SERVICES

Consumers must comply with the following guidelines when accessing and using the services provided:

  • Use the Platform and its services only for lawful purposes and in accordance with these Terms.

  • Refrain from fraudulent, misleading, or illegal conduct when using the Platform.

  • Avoid transmitting any viruses, worms, or malicious code through the Platform.

  • Do not interfere with or disrupt the operation of the Platform or the servers and networks connected to it.

  • Refrain from attempting to gain unauthorized access to any part of the Platform.

These guidelines are designed to ensure a safe and enjoyable experience for all consumers using the Platform. Any violation of these Terms may result in termination of access to the services provided.

5. PARTICIPATION

To participate in the NFC or QR Code–enabled user experience, users must scan their NFC-compatible device (smartphone or other compatible device) on the NFC tag attached to the activated bottle. By doing so, users will be redirected to a digital web page where they can access more information about the product and participate in a mini-competition or wine tasting experience.

5.1

Participation in the NFC or QR Code–enabled user experience, including scanning the NFC or QR Code sticker on the wine bottle or other medium, is entirely optional and voluntary.

5.2

The NFC or QR Code label attached to the wine bottle will remain inactive and will not initiate any action unless users choose to scan it with their NFC- or QR Code–compatible device.

5.3

By choosing to scan the NFC sticker or QR Code, users give their explicit consent to Univerre Pro Uva and the wine producer or other Univerre Pro Uva client to collect and process data for marketing purposes, as described in the Privacy Policy.

6. INTERACTING WITH LANDING PAGES WITH MINI COMPETITION

The mini-competition for user interaction is a simple and engaging activity designed to encourage interaction and participation from users/consumers.

The mini-competitions presented on the homepage are designed according to the requests of the wine producers or other clients of Univerre Pro Uva. These competitions offer participants an engaging opportunity to interact with the brand in a unique way. The following guidelines apply:

  • Competition design :Ideas for mini-competitions are initiated and managed by the wine producers or other clients of Univerre Pro Uva. They design the concept and theme of each competition to align with their brand identity and objectives.
  • Prizes and winner selection: The wine producer or other Univerre Pro Uva client is solely responsible for deciding the prize(s) for participation in each mini-competition. They also hold the authority to select the winner(s) of the competition. Winners will be notified by email, and prizes will be awarded according to the decisions of the wine producer or client. Participants are responsible for ensuring that the email address provided is accurate and functional.
  • Collection of email addresses : When participating in mini-competitions, email addresses may be collected for communication purposes. These addresses are collected and managed jointly by the platform and the wine producer or other Univerre Pro Uva client. By participating, users consent to the collection and use of their email address for competition-related communication and other marketing purposes described in the Privacy Policy.

These guidelines ensure transparency and accountability in the conduct of mini-competitions and provide users with a fair and enjoyable experience when interacting with the brand.

7. INTERACTING WITH WINE DEGUSTATION PAGES

The wine tasting experience or other product experience, facilitated by the NFC or QR Code–enabled interface, allows users to participate in wine or product tastings and share their feedback.

This experience is very similar to a traditional wine or product tasting, except that it is digitally connected via NFC (for easy access) or QR Code, enabling easy data storage and providing a smoother and enhanced user experience.

By tapping their NFC-enabled device on the designated bottle label or scanning the QR Code, users are directed to a digital platform where they can explore various aspects of the wine and interact with the brand.

The main objective of this tasting experience is to improve users’ understanding and appreciation of the product, while also collecting valuable feedback to support the improvement efforts of the wine producer or other Univerre Pro Uva SA clients.

Participation in connected tasting experiences is voluntary. Personally identifiable information (PII), such as email addresses, will not be disclosed by the system unless users voluntarily provide them with full consent for further interaction.

Sharing email addresses allows the wine producer or other Univerre Pro Uva SA clients to contact users for relevant marketing purposes related to the product. This arrangement is designed to foster trust and transparency between users and the wine producer or client.

Users retain full control over the disclosure of their personally identifiable information, ensuring that their engagement with the tasting experience remains both enjoyable and secure.

8. DATA COLLECTION AND PRIVACY

During our mini-competitions and wine or product tastings, we may also collect user preferences and ratings, in addition to data such as email addresses, first and last names, geolocation, and other relevant information depending on the requirements of the competition or event. By participating, consumers consent to sharing this data with the wine producer or other Univerre Pro Uva SA client associated with the experience for competition-related purposes. We prioritize data privacy and security, complying with applicable regulations and implementing measures to prevent unauthorized access. 9. INTELECTUAL PROPERTY

All content and materials available on the Platform, including but not limited to text, graphics, logos, images, software, and audio/video clips, are the property of our company or the wine producers and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or modify any content or material on the Platform without our prior written consent.

10. MODIFICATION AND TERMINATION

Univerre Pro UVA and the Company reserve the right to modify or terminate the NFC or QR Code–enabled user experience, including mini-competitions, tastings, or any other digital experience, at any time and without prior notice.

11. LIABILITY

11.1. Users acknowledge that participation in the user experience is voluntary.

11.2. Neither Univerre Pro UVA nor the wine producer or other Univerre Pro Uva client shall be liable for any damages, losses, or injuries resulting from participation in the user experience or the use of the NFC sticker.

12.GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the jurisdiction of Sion, Switzerland.

By participating in the NFC or QR Code–enabled user experience, users indicate their acceptance of these Terms and Conditions. The wine producer or other Univerre Pro Uva client reserves the right to disqualify any participant who violates these terms or engages in fraudulent behavior.
