TERMS AND CONDITIONS - INTERACTING WITH A SMART BOTTLE FASCILITATED BY UNIVERRE

INTRODUCTION
These terms and conditions outline the rules and guidelines for participating in the NFC-enabled user experience associated with the wine bottle, facilitated by Univerre Pro Uva (the enabler of hardware: NFC technology and software: digital experience) in collaboration with The wine producer. The primary objective of this experience is to create a delightful and engaging user experience for participants. By tapping an NFC-enabled bottle or participating in this experience through our platform, users agree to abide by these terms and conditions.
1. ELIGIBILITY
The NFC-enabled user experience is open to individuals who are of legal drinking age in Switzerland or in their respective countries where they use this bottle.
2. DESCRIPTION OF SERVICE
Our Platform offers a range of services, includin hardware solutions such as NFC labels and tags, digital printing services, and software services such as simple digital experiences, interactive digital experiences, and development of degustation experiences for products.
 The Platform also provides a user dashboard for interaction data with NFC available for the wine producers who enable their bottles with NFC tags. This dashboard consists of detailed NFC interaction reports, and the potential to export data.
3. USER ACCOUNTS
User account registration is eligible only for B2B customers, where they can access interaction data about their products. B2B customers will have access to detailed reports, interaction data with NFC, and the potential to export data through their user accounts.
Consumers (end-users) can only access the landing page front end and view related information. They can participate in interactive games, degustations, and other activities facilitated by the NFC-enabled user experience, but they will not have the option to create user accounts.
4. USE OF SERVICES
Consumers are required to adhere to the following guidelines when accessing and utilizing the services provided:
- Use the Platform and its services solely for lawful purposes and in compliance with these Terms.
- Refrain from engaging in any fraudulent, deceptive, or unlawful conduct while using the Platform.
- Avoid transmitting any viruses, worms, or malicious code through the Platform.
- Do not interfere with or disrupt the operation of the Platform or servers or networks connected to the Platform.
- Abstain from attempting to gain unauthorized access to any part of the Platform.
These guidelines are designed to ensure a safe and enjoyable experience for all consumers using the Platform. Any violation of these terms may result in the termination of access to the services provided.
5. PARTICIPATION
To participate in the NFC-enabled user experience, users must tap their NFC-enabled device (smartphone or other compatible device) on the NFC tag on the enabled bottle. By doing so, users will be directed to a digital webpage where they can access more product information and engage in the mini competition or a wine degustation experience.
5.1. Participation in the NFC-enabled user experience, including scanning the NFC sticker on the wine bottle, is fully optional and voluntary.
5.2. The NFC tag affixed to the wine bottle will remain inactive and will not initiate any actions unless users choose to tap it with their NFC-enabled device.
5.3. By choosing to scan the NFC sticker, users give their explicit consent for Univerre Pro UVA and The wine producer to collect and process data for marketing purposes as outlined in the Privacy Policy.
6. INTERACTING WITH LANDING PAGES WITH MINI COMPETITION
The mini-competition for user interaction is a simple and engaging activity designed to encourage interaction and participation of users/consumers.
The mini competitions featured on the landing page are designed under the requests of The wine producers. These competitions offer an engaging opportunity for participants to contribute and interact with the brand in a unique way. It’s important to note the following guidelines regarding these competitions:
- Competition Design: The ideas for the mini competitions are initiated and managed by The wine producers. They craft the concept and theme of each competition to align with their brand identity and objectives.
- Prizes and Winner Selection: The wine producer is solely responsible for deciding on the prize(s) for participation in each mini competition. Additionally, The wine producer holds the authority to select the winner(s) of the competition. Winners will be notified by email, and prizes will be awarded as determined by The wine producer. It is the responsibility of the participants to ensure that the provided email address is accurate and functional.
- Email Collection: During participation in mini competitions, email addresses may be collected for communication purposes. These email addresses are collected and managed jointly by the platform and The wine producer. By participating in the mini competition, users consent to the collection and use of their email address for communication related to the competition and other marketing purposes as outlined in the Privacy Policy.
These guidelines ensure transparency and accountability in the conduct of mini competitions, providing users with a fair and enjoyable experience while interacting with the brand
7. INTERACTING WITH WINE DEGUSTATION PAGES
The wine degustation experience, facilitated through the NFC-enabled user interface, offers users an opportunity to engage in wine tasting and feedback sharing.
The wine degustation experience is very similar to the traditional wine degustation, except that it is connected with NFC (for easy access) and digital so that data is stored easily, allowing for a seamless and enhanced user experience.
By tapping their NFC-enabled device on the designated bottle tag, users are directed to a digital platform where they can explore various aspects of the wine and interact with the brand.
The primary objective of this degustation experience is to enhance users’ understanding and appreciation of the product while also collecting valuable feedback for the wine producer’s improvement efforts.
Participation in the connected wine degustation experiences is voluntary. Users’ personally identifiable information (PII), such as email addresses, can’t be disclosed by the system unless users decide to provide their email addresses with their full consent for further engagement. Sharing email addresses allows the wine producer to contact users for meaningful marketing purposes related to the product. This arrangement is designed to foster a relationship of trust and transparency between users and the wine producer. Users retain full control over the disclosure of their PII, ensuring that their engagement with the degustation experience is both enjoyable and secure.
8. DATA COLLECTION AND PRIVACY
In our mini competitions and wine degustations, we also gather user preferences and evaluations in addition to data such as email addresses, names, surnames, geolocation, and other pertinent information as per competition or event requirements. By participating, consumers consent to sharing this data with the associated wine producer for competition-related purposes. We prioritize data privacy and security, complying with regulations and implementing measures to prevent unauthorized access. 9. INTELECTUAL PROPERTY
All content and materials available on the Platform, including but not limited to text, graphics, logos, images, software, and audio/video clips, are the property of our company or the wine producers and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or modify any of the content or materials on the Platform without our prior written consent.
10. MODIFICATION AND TERMINATION
Univerre Pro UVA and The Company reserve the right to modify or terminate the NFC-enabled user experience, including the mini competition, degustation, or any other digital experience at any time without prior notice.
11. LIABILITY
11.1. Users acknowledge that participation in the user experience is voluntary.
11.2. Neither Univerre Pro UVA nor The Wine Producer shall be liable for any damages, losses, or injuries resulting from participation in the user experience or the use of the NFC sticker.
12.GOVERNING LAW AND JURISDICTION
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction of Sion, Switzerland.
By participating in the NFC-enabled user experience, users indicate their acceptance of these terms and conditions. The Wine Producer retains the right to disqualify any participant who breaches these terms or engages in fraudulent behavior.
